Duty to Defend Bill Passes Wisconsin House
Assembly Bill 514, ACEC-Wisconsin’s bill regulating Indemnification and Duty to Defend provisions in public contracts, passed the Wisconsin Assembly on Nov. 14, 2023.
The bill has passed the Senate and is awaiting final action in the House.
Property Damage Expanded to Include Construction Defects in Illinois

Construction Fatalities Rose in 2022 – BLS
Construction fatalities increased in 2022 according to a new analysis released by the U.S. Bureau of Labor Statistics. The construction industry increased 11 percent in 2022 from 12.3 deaths per 100,000 in 2021 to 13 in 2022 most fatalities caused by falls, trips and slips.
Architecture Billings Decline for 4th Straight Month
The American Institute of Architects released a new report showing a decline in billings again during the month of November. It was the seventh month in 2023 that showed a decline.

The Associated Builders and Contractors Association has filed court challenges to the Biden Administration’s newly adopted rule requiring project labor agreements on federal projects of $25 million or more. ACEC was successful in securing an exemption for A/E services.

Concrete voids and honey combing necessitated the demolition and reconstruction of Washington D.C.’s Frederick Douglass Memorial Bridge. That is now the focus of a legal dispute set to go to court this year. This is the first time that a court is hearing a case on builders’ risk policy exclusions.
